There is disruption at Customs, can I use the emergency procedure?

Recently, there was an outage at Customs that prevented you from printing an EAD Customs document. It is a common occurrence for there to be an outage at Customs, and in these situations, we often receive the question: ‘I cannot print an EAD Customs document due to the outage, can I use the Emergency Procedure?’ In this article, we will answer this question.

Yes, you can use the emergency procedure in this case. However, we advise you only to use the emergency procedure if the logistics process requires accelerated declaration processing.

When can you use the emergency procedure?

You may only use the emergency procedure in the following cases:

  • If Customs informs of an AGS export failure on their website
  • Subject to Customs'permission in other cases. In this case, you must contact Customs yourself. You can reach Customs via two telephone numbers, depending on your declaration point number. Your permit will indicate which office you need to submit your declaration to.
    • Customs Declaration Handling Schiphol Cargo (0432): 088-1582000
    • Customs Declaration Processing Rotterdam Rijnmond (0396): 088-1514103

How does the emergency procedure work?

To use the emergency procedure, please contact the VWE Customer Contact Centre. We will then mark your declaration as an emergency procedure in the AGS system. After this marking, an Emergency Procedure Customs Document will automatically appear in your transaction on Mijn VWE. This document, however, does not yet contain an MRN barcode like a normal EAD Customs Document, but the message “NOT IN ECS” (see image below).

You will send this emergency procedure customs document, and any requested information (such as an invoice), by email to the competent Customs Office. In the subject line of the email, state the text ‘Emergency Procedure’ followed by your EORI number and the reference number of the declaration.

Please note! You can submit 1 emergency declaration per email. If you wish to submit multiple emergency declarations, please send a separate email for each declaration.

Customs will reply to your urgent declaration by email. They will inform you if the goods are to be inspected, or you will receive permission for the export of the vehicle. If Customs releases the goods for export, they will stamp the urgent declaration with their official metal stamp and email the urgent declaration to the return address mentioned above. The vehicle can now be exported.

Have you within 30 minutes of making an emergency declaration:

  • No response received from Customs?
    Please contact the Customs reporting point to which you sent your email by telephone to obtain release for export.
     
  • has been informed by the Customs that the goods will be physically inspected?
    You must make the goods available to Customs. The established response times also apply to this during an emergency procedure. You can find information about the response times and the rules that apply to them on the site of the Customs.

After the breakdown

Has the disruption ended? If so, a valid EAD customs document (with MRN number and barcode) will be automatically generated for you in your transaction on Mijn VWE.

The electronic declaration sent after the outage, following the emergency procedure, is not communicated with the export process (ECS). This has consequences for the arrival notification that must be made at the Customs Office of Exit and for the electronic manifest upon exit. Since an electronic arrival notification cannot be made, you must ensure alternative proof of exit to receive a Confirmation of Exit (COE). Please note! It is possible that declarations were already submitted when the fault occurred, and for which you did not receive a confirmation message due to the fault. In this case, please wait to see if these declarations are still processed electronically after the fault has been resolved.
