1. Introduction
1.1. VWE Groep B.V. and its affiliated companies (hereinafter: “VWE”) support the transport sector in the Netherlands with smart information technology and solutions. VWE is established at W.M. Dudokweg 37 (1703 DA) Heerhugowaard, registered with the Chamber of Commerce under number: 61002879.

1.3. Your privacy is important. This general privacy statement is intended to inform you about the processing of personal data by VWE in accordance with the General Data Protection Regulation (“GDPR”). Depending on the circumstances, VWE may act as a data controller or as a data processor.

2. Categories of personal data
2.1 Depending on the services provided, VWE may process the following categories of personal data. Data with an asterisk are required to register your customer, the rest is optional.

- Technical data (such as IP address and browser information)
- Vehicle identification data (such as registration number and VIN number)
- Documentation (such as vehicle registration document, where necessary for the provision of the service)
3. Purposes for the processing of personal data
3.1 We process contact details to stay in touch with you, for example in response to queries, and to be able to perform and uphold our agreements with you.
3.2 VWE shall only process personal data when there is a valid legal basis to do so, such as the performance of a contract, compliance with a legal obligation, a legitimate interest of VWE or a third party, or – where required – the consent of the data subject.
3.3 VWE acts as a processor for controllers within the automotive sector. VWE is an information provider recognised by the RDW. Information providers are organisations that facilitate communication between the RDW and individual companies (license holders) in the transport sector, and designated organisations that receive data and process it into information products. 3.4 If you have subscribed to this, we will also use your e-mail address to send you topical messages such as news, developments, and new functionalities. The legal basis for sending the newsletter is your consent. We ask for this consent before we use your e-mail address for this purpose.
3.5 Where VWE acts as a processor, the controller determines the purposes, legal bases and retention periods for the processing. This is typically VWE's client. For questions regarding this processing, VWE may refer you to the relevant controller.
3.6 You have the right to object in your specific situation if a legitimate interest is the basis for the processing of your personal data.
4. Our websites, apps, platforms and cookies
4.1 On our websites, we use techniques that can read information from your terminal equipment, or store it on your terminal equipment (hereafter: “cookies”). For example, we can use cookies to keep statistics on how many visitors our website receives and which pages are viewed the most.
4.2 We use a Google cookie as part of the “Analytics” service to keep track of statistics. This includes statistical information about the number of visitors, the most visited pages, and the duration of visits. Google stores the information on servers in the EU/EEA and the United States. Google is certified under the EU-US Data Privacy Framework. We opt for the most privacy-friendly settings in Google Analytics wherever possible.
4.3 Furthermore, we may share this usage behaviour with advertising networks. This usage behaviour will be combined by the advertising networks with similar information they obtain from your visit to other websites on which they advertise. Based on this, an interest profile will be created about you, enabling us to show you relevant advertisements on other websites, tailored to this interest profile.
4.4 You can delete cookies placed via your browser and switch off the acceptance of (certain) new cookies.

5. Beta alter mijnen
5.1 VWE does not store personal data for longer than is necessary for the purposes for which it was processed. Certain data are subject to statutory retention periods, such as tax retention obligations. Transaction and invoice data are in principle kept for 7 years. Account and customer data are kept for the duration of the agreement and a limited period afterwards, unless longer retention is necessary due to legislation, dispute resolution, or legal obligations.
5.2 The RDW determines the retention period for personal data it holds, to which VWE has limited access, in accordance with applicable laws and regulations. You can consult the RDW's privacy statement or contact them if you have any questions about this.
6. Recipient Categories
6.1 VWE may use external service providers, including hosting parties, payment service providers, e-mail marketing platforms, logistics partners, cookie and analytics tools, and service providers for specific products or vehicle-related services. These parties receive and process personal data only to the extent necessary for their provision of services. Depending on the nature of the services provided, these parties will act as processors or independent data controllers.
6.2 If VWE acts as a processor, VWE's customer may receive your data from us. This may include personal data from the RDW source. VWE will only pass on registration numbers and vehicle information from the RDW source. The basis for this is usually that this information is necessary for the services provided by our customers in the transport sector, such as garage owners. VWE explicitly does not share your name, address, and contact details (NAW) or other sensitive data from the RDW source, nor does VWE have access to those categories of data at the RDW.
6.3 If personal data are transferred to parties outside the European Economic Area, VWE will implement appropriate safeguards, such as the use of standard contractual clauses approved by the European Commission.
7. Your rights
7.1 If VWE is the data controller, you have the right to request VWE to grant you access to, and rectification, supplementation, erasure, or restriction of, your personal data, or to object to its processing. In addition, under certain circumstances, you have the right to data portability. Please direct your request, with as much detailed information as possible, to: privacy@vwe.nl.
7.2 You have the right to lodge a complaint with the Dutch Data Protection Authority.
7.3 You are not legally obliged to provide your personal data. Failure to provide personal data may mean that certain services can no longer be (optimally) provided to you.
7.4 You have the right to withdraw your consent to the processing of personal data at any time. This does not affect the lawfulness of processing based on consent before its withdrawal. Withdrawal of your consent may result in certain services no longer being available to you.
7.5 If VWE acts as a processor and you contact VWE instead of the controller, we may choose to refer you to our client.
7.6 In principle, VWE handles requests from data subjects within one month of receipt. If necessary, this period may be extended by two months in accordance with the GDPR. VWE may request additional information to verify your identity if this is necessary to prevent misuse.
8. Security
8.1 VWE shall implement appropriate technical and organisational measures to protect personal data against loss, unauthorised access, and unlawful processing. Further information on this can be found in the detailed privacy statement.
9. Amendments
9.1 This privacy statement may be amended. We will publish the most current version on our website. In the event of significant changes, VWE will actively inform stakeholders where this is appropriate or required.
